Mesh2Solid Licence Terms
This is a translation for convenience. The German version is binding.
1. Provider and purchase
Mesh2Solid is provided by Tim Hägele, c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen, Germany, email: contact@thavision.com (see Imprint).
Pro licences are sold by Polar (polar.sh) as merchant of record. Polar's terms, which you receive during checkout, govern purchase, payment, invoicing and withdrawal. These licence terms govern the use of Mesh2Solid.
2. Free version
(1) The free features of Mesh2Solid – analysing a mesh and exporting STEP on mesh2solid.thavision.com and the free features of the Fusion add-in – may be used without a licence for private, non-commercial purposes only, such as hobby projects.
(2) Any commercial use requires a Pro licence, even if only the free features are used. Commercial is any use in the course of a trade, business or self-employed profession, or for a company or another organisation, in particular where the results are sold, made to order or included in products or services provided for payment.
(3) You may create guides, tutorials and videos about Mesh2Solid with the free version, even if they earn money. The provider asks you to mention Mesh2Solid Pro and what it can do as well.
(4) Sections 4 and 7 to 9 apply to the free version accordingly.
3. Scope of the licence
The licence key unlocks the Pro features of Mesh2Solid described at purchase, such as repairing faces, repairing open meshes (closing gaps) and picking single bodies. For the term of your subscription you receive a simple, non-transferable right to use Mesh2Solid with all its features for private and commercial purposes. The files you create with Mesh2Solid are yours and may be used without restriction.
A key is for one person. It can be active on up to two devices or browsers of that person at a time. You can release activations yourself in Polar's customer portal. If several people use Mesh2Solid, for example in a company, each needs a key of their own. You may not pass the key on to others or publish it.
The Pro licence is a yearly subscription at €12 or US$12 per year; Polar shows the final price including taxes at checkout. It covers the Pro features and the updates released during its term. The subscription renews unless you cancel it; you can cancel at any time in Polar's customer portal. Term, renewal and cancellation are otherwise governed by Polar's terms. When the subscription ends, the licence key becomes invalid and the Pro features and the right to commercial use end. You may keep using files you have already created without restriction.
4. Prohibited use and suspension
(1) You may not
- circumvent the licence check or other technical protection measures,
- copy, modify, reverse engineer or decompile Mesh2Solid or its program files, except where the law expressly permits it,
- offer Mesh2Solid or its features to others as a service of your own, resell or sublicense it,
- use the service in an automated way or to an extent beyond the usual use by one person.
(2) If you materially breach these terms, in particular by passing on, publishing or misusing a key, the provider may block the key and terminate the subscription for cause. No refund for the remaining term is given in that case.
5. Changes
(1) The provider develops Mesh2Solid further and may change, replace or remove features, provided the essential services of the Pro licence – recognition, STEP export and repair – remain.
(2) The provider may change the price and these licence terms for future renewals. He announces changes by email at least six weeks before the next renewal. You may cancel the subscription until the renewal; if you do not, it renews on the new terms. The notice points out this consequence.
6. Operation and discontinuation of the service
(1) Mesh2Solid runs in your browser; the licence key is checked by the provider's server and by Polar. There is no entitlement to operation for any particular period.
(2) The provider may discontinue the service with three months' notice. He announces this on mesh2solid.thavision.com and by email to the address given at purchase.
(3) The subscription ends with the discontinuation; the provider refunds the price pro rata for time already paid beyond it. No further claims arise from the discontinuation.
(4) The provider aims for high availability but does not guarantee any particular availability. Temporary interruptions, such as maintenance or outages at the hosting provider or at Polar, do not give rise to a refund.
7. Check the results
Mesh2Solid recognises geometry in triangle meshes automatically. A mesh only approximates the original shape, so the STEP files produced may deviate from it, for example in dimensions, radii or threads. Check results yourself before manufacturing, passing them on or using them otherwise.
8. Liability
(1) The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
(2) For slight negligence the provider is liable only for breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely, and only for foreseeable damage typical of the contract. Otherwise liability is excluded.
(3) Statutory warranty rights remain unaffected.
9. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain unaffected. If any provision is invalid, the remaining provisions stay in effect.
